DA: Proof killer justified

Man who shot D12 rapper in a barroom fight "acted in lawful self-defense of another," county prosecutor says.

The man who shot and killed D12 rapper and Eminem sidekick Proof in a nightclub fight will not be charged with murder, Detroit authorities said today.

Mario Etheridge, who worked as a bouncer at the CCC club on 8 Mile Road where Proof--real name Deshaun Holton--and another man got into a brawl that turned into a gunfight in the early morning hours of April 11, acted in self-defense, according to Wayne County prosecutor Kym Worthy.

"The evidence clearly shows that Mario Etheridge acted in lawful self-defense of another when he shot Deshaun Holton," Worthy said today, according to the Detroit Free Press.

The announcement caps a tragic incident in which two men died over a disagreement about a pool game at 4:30 a.m. at a club that wasn't supposed to be open.

According to several witness accounts, Proof, 32, pistol-whipped and shot Etheridge's cousin, Keith Bender Jr., in the head. Etheridge, in turn, shot Proof several times in the chest and head. Proof was dead on arrival at a nearby hospital, while Bender died a week later.

Etheridge is still facing charges of carrying a concealed weapon and discharging a firearm in a building, both felonies.

R.I.P DESHAUN HOLTON

Whoever reads this, I just want them to know Proof will ALWAYS be loved, not just by people that knew & loves him, but by people who loves & feels as if they know him through his music & his words. I'm a huge D12 fan and not just because of Eminem, I have always treated D12 equally and don't refer to them as 'Eminem's band' because even though I may reflect to Em' more than other members, they will always be equal in my heart & I love each of them. I always took a liking to Proof because he was something differnt, his voice was extrodinary & what he was saying helped me along with my life, I'm only a kid but his music will always be in my heart. I didn't believe he had passed away, I signed into MSN one day and just saw 'R.I.P Proof' in peoples MSN names, I just thought it was a sick joke & signed out as quick as I could. I wouldn't believe it. Still can't. I will miss,love & respect Proof as much as people do for Tupac, Biggie and Bob Marley. He's a true legend and I love him, when I say 'love' its more than fan love its NOT fancy love it's just pure legend love,I feel as if D12 is family or God to me, I've never met any of them & wouldn't want to, for me to meet them is like a highly religious person meeting God (who they love,repect and live by) they would probably fain or die (which even though it sounds silly, I feel as if I would do to.It's that kind of love.) People think I can't love him, because I don't know him, but the way I feel about most artists under Shady/G-Unit/Aftermath records is that they are like God to me, their music is pretty much the only reason I am who I am today. So for Proof to die it has had a huge effect on me.

We will love & miss you Big P
