Beach Boys lawsuit heading to trial

Mike Love is suing Al Jardine for more than $3 million over Jardine's use of the band's name in promoting his concerts.

The long-running feud between Beach Boys Mike Love and Al Jardine over the latter's use of the band's name in promoting his solo concerts will go to trial, a judge ruled this week.

Superior Court Judge James R. Dunn denied Love's motion to rule immediately in his favor in the case, which dates back to before 2003, when a federal court ruled that Jardine needed to cease using the Beach Boys name, to which Love claims exclusive rights.

Love is seeking $2 million in court costs and another $1 million in earnings he said Jardine wrongly was paid for using the Beach Boys' name in connection with other bands in which he has performed. Those bands include "Beach Boys Family & Friends," "Al Jardine, Beach Boy," and "Al Jardine of the Beach Boys."

The case will be heard by a jury, but no date has been set for the trial. Love and Jardine cofounded the Beach Boys in 1961 with brothers Brian, Carl, and Dennis Wilson.

Brian Wilson continues to tour and record with his own band, and Jardine recently joined him for a tour featuring performances of the Beach Boys' classic album Pet Sounds.

Mike Love has never realized (or at least admitted) that if good fortune hadn't placed him in Brian Wilson's path, he'd probably be enjoying a lucrative career as the night manager at a local fast food restaurant. I'll give Mr. Love this: He's always had a unique, nasally voice. This doesn't mean that he's a great singer though. His talents as a lyricist are negligible. Suing Brian so that he could get credit (read, "more money") for lyrics like, "member when you spilled coke all over your blouse"? Grow up, Mike.

Brian Wilson is the only person alive who should legitimately claim the right to the name, "Beach Boys", but, unlike Mike, people love, respect and will pay money for new product and to see him perform live based on his (Brian's) own given name, with or without the "Beach Boys" tag. Those who really understand the history and the music of the Beach Boys know where the talent was and is, and it ain't with Mike Love.

Mike Love touring around the world, calling himself, "The Beach Boys" is akin to Ringo Starr calling himself, "The Beatles". Ringo is too class an act to ever do that. He understands that, yes, he had talent and contributed to the wonderful sound and mystique that was The Beatles, but that he's not "The Beatles".

Count your blessings, Mike Love. Brian Wilson was and is the talent of The Beach Boys. The other members of the band including Al Jardine, Bruce Johnston and CERTAINLY Carl and Brian Wilson ALL had better voices and more talent than Mikey ever had. You did write some okay lyrics...on occasion. You had a voice that worked well with the teenage sound of the early Beach Boys songs. You acheived mega-fame and have made millions and millions of dollars. Now, do us all a favor and go away.
